It states the flag shall not be draped over the hood, top, sides or back. Then states a flag staff must be affixed to the chassis or right fender. My truck bed is affixed to the chassis and has a staff affixed to a structural member of the bed, it is affixed to the chassis. Plus I fly the flag on the right side. No code violations.

@Aaron Small Very succinctly expressed. You have identified the problem exactly. "It" was "never proven" and that is the inherent danger.
We have all heard of an individual having been executed several decades ago being exonerated too late due to a culprit's death bed confession or a reinvestigation with recent DNA technology. And these injustices occurred with the detached and sober calculations of the legal system. How less calculating and rational heated emotions and vigilantism are.
