El Esequibo...¿Un despojo? Sinopsis: . "Poseemos suficientes elementos de probanza: jurídicos, históricos, demográficos y cartográficos, para presentarnos en cualquier escenario, valga decir la Corte Internacional de Justicia, para mostrar y demostrar que mediante un ardid tramposo,....." Hoy me complazco en realizar y presentar a Uds., una entrevista con el Dr. Abraham Gómez Rodríguez, destacado miembro del Instituto de Estudios Fronterizos de Venezuela y de la Fundación Venezuela Esequiba, sobre nuestra disputa por ese territorio. ¿Quién es el Dr. Abraham Gómez Rodriguez?
El Dr. Gómez, a lo largo de su vida, tuvo un marcado interés por su superación personal. El estudio fue su gran pasión; pertenece aún, al gremio de los estudiosos, más que de los estudiantes. Siempre tuvo excelentes maestros y asesores.
Hace más de tres décadas, diseñó curricularmente, fundó y dirigió, por varios años, el Instituto Universitario de Tecnología, en el Delta del Orinoco, ese que ahora se denomina Universidad Territorial Deltaica.
Hoy, después de una dilatada e inacabable trayectoria académica, la perspectiva en la que se inscribe, apunta hacia la reivindicación de la Guayana Esequiba, una séptima parte de nuestra geografía nacional, que no es poca cosa. Para que tengamos un referente, esa extensión territorial que nos arrebataron, es equivalente a la superficie de los estados Táchira, Mérida, Trujillo, Lara, Falcón, Zulia, Miranda, Aragua y Carabobo; además, de su respectiva proyección atlántica con sus incalculables cantidades y tipos de recursos de todo tipo. Ese asunto litigioso, que como país, sostenemos desde hace más de cien años, fue precisamente el contenido esencial de su tesis doctoral, en la Universidad Central de Venezuela. Este, también, ha sido el tema con el que ha venido recorriendo varias universidades y otros organismos del país, dictando conferencias. Motivado a la pandemia, los intercambios de opiniones, ahora, se efectúan vía zoom, por radio y T.V..
Aparejadamente, también es miembro del Instituto de Estudios Fronterizos de Venezuela y de la Fundación Venezuela Esequiba.
Desde hace varios años, fue igualmente incorporado a la Academia Venezolana de la Lengua; se nos ha informado tambien, que un grupo de catedráticos, maneja la propuesta de incorporarlo a la Academia de Ciencias Políticas y Sociales. Estas son algunas de las calificaciones de nuestro entrevistado de hoy, Dr. Abraham Gómez.
¿Dr. Gómez, podría Ud. ofrecernos algunos de los antecedentes de esta disputa por el Esequibo.?
"La contención que hemos llevado adelante, la hacemos no por un capricho, empecinamiento o malcriadez diplomática: poseemos suficientes elementos de probanzas: jurídicos, históricos, demográficos y cartográficos para presentarlos, en cualquier escenario; valga decir, la Corte Internacional de Justicia, para mostrar y demostrar que, mediante un ardid tramposo, denominado Laudo Arbitral de París, el 03 de octubre de 1899, nos despojaron de esa considerable parte de nuestro costado Este.
Los documentos que nos asisten, en justeza, son considerados conforme al Derecho Internacional Público, Iuris et de Jure (no admiten prueba en contrario). Veamos: la Cédula Real de Carlos III, del 08 de septiembre 1777, nos constituye como Capitanía General de Venezuela, con las provincias de Maracaibo, Caracas, Nueva Andalucía (hoy Cumaná), Margarita, Trinidad (que fue nuestra) y Guayana que llegaba hasta la mitad del río Esequibo. Este fue descubierto y recorrido por primera vez, por Juan de Esquivel, acompañante de Colón en 1498, en nombre de los Reyes de España, basados en la Bula papal de Alejandro VI. Así también, podemos citar un legajo de la cartografía de Cano y Olmedilla, la de Joseph Hadfield, la de Agustín Codazzi y la del exrector de la UCV Muñoz Tébar.
De tal manera que no le estamos quitando nada a nadie, ni pensamos hacerlo; al contrario, somos nosotros la víctima de la tratativa perversa con la que se actuó en la fecha citada.
¿Por qué la disputa, habiendo suficientes pruebas que hace nuestro el Esequibo?
Precisamente, el Padre de la Patria fue el primero en advertir la estrategia de usurpación y vulgar ocupación con que venía actuando el Imperio inglés, a partir del año 1814, cuando hace arreglo con Los Países Bajos, mediante el Tratado Anglo-holandés; por eso Bolívar teoriza y sugiere la invocación, en el Congreso Anfictiónico de Panamá, 1826, del Principio del Uti Possidetis Juris, para aquellas naciones que fueron alcanzando su independencia.
Conforme a la jurisprudencia de la Corte Internacional de Justicia, hay una tácita aceptación e intangibilidad de las fronteras heredadas; siempre y cuando presente el Estado interesado y concernido, su Justo Titulo; que, en nuestro caso, estamos apertrechados de bastantes documentos que prueban que la Guayana Esequiba siempre ha sido nuestra.
¿Cómo sabemos cuáles son los límites del territorio en reclamación?
Basta una indagación en los legajos históricos que las Partes conflictuadas podamos presentar, ante el Alto Jurado sentenciador de La Haya, como la cartografía mencionada y otras que poseemos; los Títulos (por ejemplo, el del 30 de marzo de 1845, cuando España nos reconoce la Independencia) los Tratados que suscribimos con los ingleses, en 1850, (que jamás respetaron); el Tratado con Brasil, en 1859 (delimitación por cuencas de los ríos Amazonas, Orinoco y Esequibo).
No hay nada de que temer; debemos hacernos parte del juicio ante la Corte, para el 08 de marzo del 2023 y consignar en nuestro memorial de contestación de la demanda, todo cuanto nos respalda en este litigio. Con estas evidencias, pareciera muy obvio que la Guayaba Esequiba es parte del territorio nacional. During my last 2 visits I was honoured to meet Wynton Marsalis and have a long chat and a drink with him - a lovely man - down to earth and humble given his immense stature in the world of jazz.
