Being a American living in Australia, as I married a Australian. I am rather enjoying this channel and it's videos as it teaches me things about the country I now live in that are not normally discussed.

My first wife used to sell biscuits at Salamanca Market. She would spend hours on Friday night baking and packaging and then we would hit the market early the next morning. Early into the enterprise she realised she didn't really have enough and decided to bolster the supply with ANZACs as it is what we had ingredients for. She didn't expect to sell many but didn't want to turn up with only half a table of product. She baked about 30 dozen and we sold them all by 10:00AM. People went nuts for them. Often buying a bag and coming back 20 minutes later to buy another (she does bake the best ANZACs ever and this is my EX-wife I'm talking about). One morning we arrived to see an international cruise ship in port and it wasn't long before we had a US tourist standing in front of the stall. First he questioned the price - I explained that we made around 30 cents a bag. Then he spotted the ANZACs and asked what they were. We explained the history and I offered him one for free. He took one bite and his eyebrows went up. He paid for that bag and bought 3 more before he left. He didn't even look at the melting moments or the chocolate chip. Within 15 minutes we had sold every bag of ANZACs we had and explained the story a dozen more times (including the fact that we call them biscuits and not cookies, which I believe comes from a Dutch word). I like to think we did our bit spread the history around and didn't just provide people with extra calories to burn.

Ohhhhh, melting moments? I'm actually not a huge fan of ANZAC biscuits (I find them way too sweet with the golden syrup in them) but I'd scarf the lot of those melting moments!!

As a Kiwi I endorse these restrictions. Also, I've eaten plenty of biscuits in the last 60+ years, but NEVER a cookie. Also, I have really enjoyed reading a comment section so full of stuff from us Kiwis and Aussies, makes a welcome change.

Thanks Mate. Whilst is so very true that we love to take the piss out of each other. It’s also equally true that we will stand shoulder to shoulder when we have common cause, against all comers.
And defending the commercialisation of Anzacs. Is actually something that both of our countries governments have actually got right, and from all sides of politics too.
And that’s very rare indeed.

P.S. Yes, we take the piss out of each other when we can, but some things just aren’t funny, and should indeed be respected.
And for any foreigners reading this. You will never find a Aussie or Kiwi, derisively mocking anything about Anzac. It’s just not done.
And if you try it. You will find two countries United against you.

I still hold a minor grudge for not winning the Anzac biscuit competition at my work a few years ago. Mine are inspired by the traditional recipe but I prefer them a bit softer (as they don't need to last several months), and add sliced dried apricots and poppy seeds (these felt fitting). This is fascinating. I'm curious about the approved recipe and how many modifications can be made- I'm vegan and I've definitely bought 'anzac' cookies that were either accidently vegan (if you're not vegan you might not know that this happens a lot with 'cheaper' items because they use vegetable oils instead of eggs, milk and butter- ALDI custard creams are even vegan!) or marketed as vegan. Coles sells 'free from' Anzac biscuits with no gluten but a I couldn't find any vegan ones in a quick google search. I personally feel that a vegan modifications would be in the spirit of the original as it would help with preservation (since animal products normally go off more quickly). As long as it's not some health food abomination that completely compromises the deliciousness and texture I hope that vegan anzac biscuits are approved.

They were originally called Soldier Biscuits and someone lady in Adelaide called them Anzac Biscuits later during WWI.

The important part of biscuit is that "bis" means twice in french, "bis-cuit" literally means "Twice cooked", which any real biscuit must be. Now Cookie's root comes from the word for Cake, and thus is baked once to produce a soft texture. This has some legal president in the UK where Jaffa Cakes were legaly determined to be a series of small cakes rather than biscuits (as cakes did not have to pay as much sales tax) and the determining factor was that a jaffa cake is soft and goers hard when stale (like a cake)

That's a different problem entirely with a whole heap of legal landmines and a corporation which are just honestly scum of the earth. You'd need courts all over the world to classify the term 'ugg' as common use for any sheepskin footwear for their trademarks to be nullified, and unfortunately outside of Australia and NZ that's not really the case because the only 'ugg' which exists are theirs.

In general the term cookie is used for quintessentially American style of biscuits e.g. choc chip cookies or peanut butter cookies, but if it's something traditionally British or Austalian like shortbread, or ANZAC it's labelled biscuit. In the same way as you'd treat something that comes from another language e.g. Italian Biscotti.

It's also said that ANZAC biscuits were made using ingredients that were available despite government rationing programs.

However the government didn't ration supplies on the home front during WWI.

And when they did in WWII, it included two of the ingredients of ANZAC biscuits (butter and sugar).

Maybe people thought rationing was why the sugar in ANZAC biscuits is golden syrup instead of refined sugar? I'm pretty sure the real reason is that golden syrup is cheaper. Just about any edible oil would work as a substitute for the butter though I'm not sure how common or available other oils were (except for animal fats like lard).

I'm surprised that ANZAC Bikkie didn't get through but better to have clear lines. I think they should also require that products are mostly made in Australian/New Zealand, from local ingredients - if not 100%. That would make locally made ANZAC biscuits more Australian than most Australian flags.

I’m no lawyer, but US trademark law apparently always allows a trademark if it contains the applicant’s name or is a distinctive part or property of the product. For example, two companies can be called Goodyear because goodyear rubber is a phenomenon. Two people with the same last name can use their names in their products.

Also, biscuits and cookies require different doughs to make, so I could perhaps see how the Australian government is protective of this.

When someone uses the word biscuit to refer to a cookie I usually think of those really hard flat cookies that also explain the word dog biscuit. Vs something like a chocolate chip cookie which is softer and thicker. Biscuits are shaped more like crackers but are way harder and more sweet vs salty.

Seeking The Love That God Means

To simplify, it appears the word "Anzac" has been granted trademark status for a certain formulation of "biscuit" product among WIPO signatory countries, as well as through special case legislation in Australia.

In the USA, at least, it has been generally allowed to advertise "If you like [Someone else's trademarked brand A] you will love [Our own trademarked brand B]." This is considered a fair comparison, at least within reason. However its own military services enjoy trademark protection. One might have an "Old Navy" brand, but not a "US Navy" brand without licensing.

So I could say "If you like Anzac Biscuits you will love America Military Cookies" (with or without chocolate chips) but not, say, "US Air Force Cookies."

I do not know why, having seen the example recipes, one would even want to make a "chocolate chip Anzac biscuit" because it is an eggless recipe that turns hard, and the textures would not go together well. However a pair of Anzac biscuits might be usable with chocolate and marshmallow to make some decent s'mores.

Actually your point about this was the first time Australia had sent troops as a national entity is in correct. After the colonies of Australia formed the Commonwealth of Australia (federation) on the 1st of January 1901, the new Government of Australia sent "Commonwealth" contingents to South Africa and thus this means that the Second Boer War was the first war in which the Commonwealth of Australia fought as a national entity.

I think he meant to say that it was the first time the Aussies and Kiwis sent troops together as one entity. If it was just Australia it wouldn't be ANZAC but would be AAC which doesn't flow as easily :)

Anyway this particular point about it being the first time Australia had sent troops as a national entity has been wrongly taught for many years as has the point about the Gallipoli campaign being the "Baptism of Fire" for Australia as a nation. People are now trying to get both points rectified as being incorrect.

@lazyfrogonalog it was not two nations fighting as one nation. The formation of the Australian and New Zealand Army Corps was an administrative formation (as are all corps) that also included units from the British army and navy and the British Indian army. In fact the commanding officer of the Corps was from the British Indian Army and most of the corps staff came from the Indian Army as well. The Australian and New Zealand Army Corps was actually a multi-national formation.

I suggest you do some research into it as you will see that it is not as clear cut as most people think it is.

I read article 6ter of the Paris Convention and it seems to say in paragraph (2) that other countries only need to prevent the use of ANZAC in biscuit and cookie-related trademarks, not ALL trademarks. So you really could sell Anzac Mr. T pots, just not in Australia or New Zealand.

I've never heard of Anzac cookies (there, I said the "c" word) so I must have missed them when I was in Australia and NZ. We have the same problem in the UK with Cornish Pasties which now have to be made in Cornwall, even though they have been made everywhere and often better for hundreds of years.

Well, having worked in the baking industry many years ago I must disagree. The difference between biscuit and cookie is the fat content and moisture content when cooked. Cookies have a much high fat content and , generally, are baked for a much shorter time for a moister result. They are not meant to be stored for long but to be eaten within a few days at most. Biscuits are dryer with much less fat and are made so that they can be stored for a much longer time. Originally ‘ biscuit’ meant ‘ twice baked’ this meant they were so dry they wouldn’t spoil and were especially suitable for long voyages or long military campaigns etc. In the modern day cookies are quicker and easier to manufacture requiring only extrusion and wire cutting to form and a short baking time, in a smaller oven if it’s a continuous process. Biscuits often require a more elaborate moulding of forming process. Despite the official name, an Anzac is, in fact , a cookie. Anyhow, they’re usually just called Anzacs. BTW, the original recipe didn’t have coconut where as now they almost always do. Also ATW, what ever the authorities say, in homes around Australia the term is fairly generic and everybody’s makes them however they want- even with chocolate chips!

Not all biscuits are cookies but all cookies are biscuits. Cookies are a subset of biscuits, soft and usually containing chocolate chips or similar.

Ironically, it's probably more accurate to describe ANZAC biscuits as cookies. The literal meaning of the word biscuit is twice cooked. Since ANZAC biscuits are only baked once, they aren't really biscuits.

I always took a cookie to be soft and chewie (No not tasting like a Wookie)
and a Biscuit hard and frangible.
And don't get me going on the difference between
a Scone a Scoun and the bastardized delicious US version labeled a Biscuit.

completely agree the soft semi-chewy half cooked, half cookie dough variety is very different from a true biscuit. cant send a limp biscuit (or cookie) across the world to troops.

Biscuit actually means 'baked twice' so usually you'd be right. I guess the ANZAC is a special case.

If I understand the part about the WIPO correctly, signatory nations won't allow the word "Anzac" to be used in a trademark. But companies aren't required to get a trademark in order to name a product that they sell. For example, if I open a restaurant in the U.S., I can call name a dish "The Hungry Dutchman", and unless that is already somebody else's registered trademark in the same field (in this case, food), nothing will happen.

So if at this hypothetical restaurant, it seems like I could create a dish that has the word "Anzac" in it, even a cookie, and as long as I don't try to file a trademark application with the USPTO, I'm good. Do I have that right? Or could Australia sue me for using Anzac in the name of the dish, even though I haven't trademarked the name?

In 1915, my grandfather spent three months at Gallipoli, before being stretchered off ... with appendicitis. I suspect Anzac Biscuits were the cause.

i used to sell cannabis cookies based on the ANZAC bickie, i just called them cookies tho, also my horse is called Anzac, because even tho he's a smallish horse(14.2 HH) he's a brave lil feller with a big heart, my grandfather fought at Gallipoli, and the with the lighthorse and whipped the arses of the Turks at Beer Sheba, i have a great respect for the ANZACs
