It's not as simple as that. The law is not stupid. It's made and considered carefully everyday by reasonable ppl like me and you. It's not always reported with all the facts and nuances. For instance, one cannot generally acquire the (false) 'right' to kill someone. But the law offers 'exceptions' where killing is necessary to preserve the (genuine)'right' to defence of self and property. But if the situation becomes one where there is no longer a reasonable threat to a right, then the exception evaporates. So killing a restrained invader is not the same as killing an 'active' invader.

Happened in England last year, old guy fights burglar while his dying wife lays in her bed and stabbed the burglar with his own knife, old man is arrested and the police allowed burglars family set up a shrine at the old guys house, banned neighbors from tearing it down. Old guy gets released and receives multiple death treats and eventually has to leave his home and go into hiding.

It would be a very difficult task to make changes to this because Canadian laws have evolved to the point where you actually have very few rights to protect your family and posessions. It's a fine line to tread when you dont know if the guy is armed and is looking to do physical harm or not. Laws should be changed to support defense of your property, especially where response times are slow. Some rural areas the response times can be up to an hour. Lots of time to be tortured to death.

There should be absolutely NO limit to your rights as a home owner or a person in their home to defend against a home invasion. You should be able to do anything you need to do to stop them, hold them till police arrive & deter them. If someone enters your home you should be able to shoot at them until either they run, give up or you kill them! Once you begin committing a home invasion and you've stepped foot into another person's home illegally it should be a law that you have at that very moment forfeited ALL of your rights to the home owner and you should have absolutely NO rights to safety or life!

Breaking into people’s house is malicious in nature. While you should detain only as much as you need, the force that is used to stop the suspect should be whatever that is sufficient to do so plus a healthy margin incase it’s not enough to stop them.
