Jerome Kern's widdow tried to have this recording Banned, fortunately the Supreme Court Justice that heard the case was Jazz fan.

That lawsuit was apparently against the later Stan Kenton arrangement with Maynard Ferguson on trumpet (which Ferguson first performed with Charlie Barnet), not Gillespie and Parker's record. But I think it's true that this Bird/Diz was the first important jazz recording of the song.
