It's not known for certain who is responsible for Mary's death. The puzzle has deliberately been left unsolved, so that we as the audience have to decide for ourselves who the guilty party is.

Marx himself is one suspect, because he's pleading that he's innocent, and it's possible people could argue that since she's the only person in the whole town who was nice to him, he wouldn't have done it. However, despite that, his lyrics are contradictory, which can possibly indicate that he's lying i.e. he said she went out alone, then said, 'I left her by the river'. How could he have 'left her by the river' if she was alone? However, that could also be taken simply to mean that he was by the side of the river the last time before she died.

Another theory is that Mary's lover is responsible. It's possible that he may have been jealous of Mary's friendship with Marx, flown into a rage and killed her. That way, although he would be losing her, at least he wouldn't have been losing her to Marx.

The Sheriff is another suspect because of the way he's seen smirking when the other townsfolk accuse Marx of being the killer, and due to the way Mary is seen running from the police car. (This is the theory that I believe).

Another theory is that Mary committed suicide, although since it's shown that she was lying at the bottom of the river having been strangled with the scarf, this is unlikely to be the case.

Some people may say that it's not possible to tell who is responsible for Mary's death due to a lack of evidence.
