I understand your perspective. But humans come in almost infinite variations. Among them there will, statistically, thanks to the law of large numbers, be some few who begin rotten only to grow into fresh fruit of life. None of us get to choose who or when we are born- what mix of genetics, epigenetics, time, or place we come into being. So some will draw short straw and be snuffed out too soon, and some will draw a equally short straw and be the rotten thing, that never had a chance either to be anything else but the one who snuffed out the other. Both are tragic.

But just because only 1 of the two tragic fates remains does not mean that the improbable growth from rotten to redeemed Is impossible.

In that case, should we not try to allow for the good that could still come forth to do so?

The impulse to eternally punish someone who may yet be able to contribute something positive to the world should be tempered, because to deny the world any measure of goodness is not only also tragic, but wasteful as well since no punishment can return a lost life.

This is precisely what the invention of forgiveness was for, to allow good to grow and grow and eventually overtake the bad. Forgiveness is not about forgetting, but about providing fertile ground on which greater goods can overtake our baser instincts to burn it all down.

When and where we can reasonably do so, we must give as many people as possible a second chance to do do right by the spark of life in them that reaches back at least 4 billion years where we all began. Because on the cosmic scale, the ending of one life is not balanced by the ending of another. No, it is balanced by the LIVING, in humble gratitude and honor, of another life that would have otherwise also ended, or never begun at all.

Balance and fairness are not the same thing, nor are they always mutually exclusive.

Counselling is helping a person to recognise and acknowledge what is happening within themselves, and the impact of their life experiences on them. It is helping them to find their own strengths and abilities to heal, and to create positive and effective coping strategies for future difficulties in order to thrive. 💖

We cannot know for sure at this stage whether he has had this level of genuine support in prison, and we cannot know for sure right now how capable he is of providing it in the future. I am always hopeful, because I have seen other murderers who have completely changed their lives around and who are now helping troubled youth and older people. 🙆🏻‍♀️ 😊 💖 🌿 👍🏾

One of my old teachers actually knew one of his sisters. She was quite violent, and the school was in a residential I was in. There was a lot more going on in the household that many didn't know about, not necessarily abuse but there was a lot behind what happened that only those close to them in areas where mental health was a concern really know. This is an example of mental health going untreated and just not understood. The mental health system needs to be refined and reformed, it could prevent this from happening again.

I agree with you! As someone who suffers from mild depression and anxiety the mental health system is years behind in progress of what it should be! A lot of doctors will prescribe medicine even though the side effects can do serious harm to people especially if you're the medicine for long periods of time! Finding the right doctor is also a hassle and can be severely frustrating I can't imagine someone with severe mental issues because the help is limited and it can take years to find what you're truly suffering from and get the right help! ! The biggest relief I have found for me is going to the gym , meditation , music and finding stuff to keep your mind busy .

Fran’s (my mom’s best friend) father was home while this was for going on in his backyard. He didn’t hear a thing. Supposedly there was a lot of violence in the home, not that this excused his actions. And if I remember correctly, Smith suffered from fetal alcohol syndrome too. Smith’s great grandfather had been sheriff or police chief of the town, and he was one who figured out that Smith had killed Derrick. He thought that maybe Smith had seen something, and had no idea that Eric would confess. The town was very very small, and it was just horrible.

School don't know how to resolve it, and if teachers and especially principals can't keep it quiet, they lose their jobs. The problem isn't at the lower levels. It's at the highest level. It started with the federal policy over school set by the Secretary of Education, POTUS, and Congress. There needs to be a federal mandate that states and local government cannot override in order to protect their funding. It all boils down to what people will do to protect their money.

I didn’t realize how true this was until my middle school child brought a girl friend home because she was bleeding. She told me two older girls shoved her down and shoved her again while site was getting up. I reported it to the school and nothing happened to the two girls. But when it happened again and this girl fought back, it was she that got in trouble. I don’t understand how this can happen. What is in it for the schools to be on the side of the aggressors and leave the kids being bullied to defend themselves? Someone please explain this to me.

To have your child die is horrible enough, but in such a way is hard to imagine. To have to relive that horror every 2 years at a parole hearing is like salt in a wound. For the convicted person to want to get married, have a family, get a job, live the American dream when your own child lost all of that at the age of 4, no words….

I'm not sure any US citizens realise how tough their sentencing laws are. In the rest of the world Smith would have have been released from a youth facility at 18 unless he was deemed to be incompetent or experiencing any array of barriers. I would interpret that as him being a psychopath and after 30 years he has learned how to either mimic emotions or fake them, knowing that is what the therapist needed for her clinical notes for the parole board. But that also means he is probably an ongoing threat to society. Especially being incarcerated since he was 13. Not everyone can be saved and society would probably be safer with his ongoing incarceration.

I think he figured that blonde haired people didn't get picked on and being a red head with freckles made him a target, something that he really can't change, so he probably felt that being bullied would be the story of his life while others who were quote on quote 'acceptable' would be forever exempt. I'm not laying the blame onto bullying alone, nor am I saying that bullying is the only reason these types of killers exist but, for some of them it does play a significant role, in their minds at least, as to why they feel prompted or justified in their actions. It's not an excuse. It's not always the sole cause either. Like I said, there are people who suffer daily at the mercy of bullies, or lack thereof but, they don't end up hurting or killing other people. There are things I bet they had to take into great consideration before releasing just as they had to consider before convicting and sentencing him. One obviously being his age at the time of his offense. Then there are the evaluations. You also consider the suffering of the victim's family and the 4 year old boy who died so young and it was a bloody and violent death most likely. That's why it took 28 years for them to finally determine that he should be set free. Of course the family of his victim won't be happy but they have reason to be set in how they feel. No matter what his life has been shattered by the time he had lost and he did not come out of it unscathed. Justice has been served.

Just FYI jail is where you're put after you're charged until you're sentenced (unless you're granted bail and can afford it), and where you do your sentence if your crime is a misdemeanor (and misdemeanors carry a sentence of 1 year or less). Once you are sentenced for a felony, you are sent to prison, and the term you were looking for was "prison system." I was a 7 when I first herd about him, I think this was my first time feeling disturbed that a kid could do such a thing to a little kid. I never forgot! It was scary.

You say he needs help right. There is no help in prisons. Behavior doesn't get corrected in prisons. Society would rather stick people in a cell and forget about them as if they aren't even real people. They get treated like property. Because they are seen as just that. The property of prisons is funded by taxpayers like you and I.

Starting at age 41, being out the Pen for killing a 4yr old. I don’t think there is much of a life for him. He is going to struggle to catch up and having a family is going to push him back another 15-20 yrs.

I cannot imagine how scared Derrick must have been. It must have been so painful. A innocent four year old who never did anything to anyone. I don't understand how anyone could do this. Derrick never got to grow up and have a family of his own. he didn't even get to kindergarten. This is sick. I feel so horrible for him. He was so little. he was just walking. This happened in my town when I was a kid. I remember when he pretended to help look for the murderer, i wish he was locked up forever. It was the most awful tragic thing that ever happened in our town. He got Derek to follow him in the woods by acting like they were going to play together, then he beat him to death with a stick.

He beat him with rocks on his head and all over his body, strangled him, then when he was dead, he sodomized him with sticks. I'll never forget how creepy he was as a kid, riding his bike around the cops, all excited by the commotion when they were looking for Derrick.

Yeah, I was in high school when this one went down. I always stuck up against bullies trying to push their agenda on others who were not as strong in the ways. I was the cool All-State dude. When I said cool it, the bullies knew damn well, to cool it. It really wasn’t something big at our school though. We went to a public school that was top 10% in academics and won State in Sports programs in the State of Texas.
