I volunteered to be tased for a law and order class last semester and believe me, it hurts like hell. If you've ever been running or swimming and gotten a leg cramp (a bad one, like when your muscle curls up and you can't move it)... imagine that all over your body. You could probably stand it for a short while, but if they keep tasering you, or don't shut the taser off, it can not only hurt you, but do serious nerve damage.

And he departed from the rules of UF forum guidelines. This wasn't the first time he did this, but he was given a second chance. UF was the one requesting police remove him, not Kerry. From my understanding, questions needed to be submitted and approved prior to the event. He started asking other questions and departed from the rules. That is why his mic was cut and he was removed.

They weren't arresting him at the start, they were just escorting him away from the mic, after his allotted time for talking ran out. It wasn't until he began to resist them, and everyone got physically involved, when they needed to get him under control.

The reason for asking him to leave is solely between the property owner (UF) and the subject, not the LEOs. The police were only there to assist escorting him off the premises. Their job is not to play as mediator, but to remove him from the site. Like I said, once he refused to leave, it became trespassing. Once he laid his hand on the officer, it became battery on a LEO and resisting arrest.

You're right. They don't have the right to remove somebody for asking a question. The right to remove somebody for cutting in line, disrupting an event, harassing the speaker (Asking questions you won't even allow the speaker to answer!), and then refusing to leave, however, is grounds for arrest.

As I see it, when the grabbed him, they were escorting him out of the building. If he were under arrest at that point, cuffs would have been put on. Just because he asked "Why are you arresting me?" doesn't mean at that time he was under arrest. The questions he asked weren't illegal, his presence on property was as soon as he pulled away from the police escorting him off site was.

You do know that criminal law is state law, therefore the law in Florida isn't necessarily the same as Maine or Indiana (where the cases you cited were decided). Also what year were those cases decided and in what court, let's use some proper citation if you're going to be making legal claims.

When he wasn't aggresively breaking the light hold the officers had on him when he was being brought away from the mic, or when he wasn't jumping up and down, and trying to run away screaming for help? Also, why is he making sure his questions are being videotaped, and why it's been reported he was "lighthearted" during the ride to jail, saying "I don't blame you...You were doing your job"?

I'm still confused as to what he was being arrested for. Law enforcement officers have no constitutional right to even TOUCH another human without provocation. I've been beat bloody for telling a friend to call my lawyer and tossing him my wallet with his card in it. I was then charged with "verbally assaulting a police officer".

What I've read is that he made a reference to a sex act, and that they probably wanted him removed after that, which is why I understand they cut his mic. You can see in one angle, of a man behind two police officers, possibly the director of the event, signaling to cut the mic. I don't remember hearing a reference to a sex act in the video, but maybe I wasn't listening close enough to that part as he was rambling on and on without allowing Kerry to answer him.

Apparently the police used Drive Stun, which is to cause tremendous pain to the opposer but also not affect the nervous system, thus rendering the opposer still conscious during the whole time. So clearly you don't know what had happened during the police involvment.

In Toby's daily vlog channel if you watch the video "ANNOYING ORANGE ON DVD!!" he tells you that he needs to pick up his friend, Andrew Meyer up, and that he is the guy that said "dont tase me bro". Also if you watch Toby's video "Samara Pulls a Fast One" you can see Toby and Andrew doing a skit together, and also in the credits it says "Guy eating Corn Pops - The Andrew Meyer". Also that video was posted in 2006, a year before the "Dont tase me bro" video came out (2007)

watch the first video in the related videos on the right. shows the whole incident. the boy was being very disrespectful towards the officer, and towards John Kerry. He was disrupting the event, and when they lead him off, he continues to make a big scene. if you watch the video, you see that he struggles THE WHOLE TIME they are trying to lead him away. Even when they have him on the ground he continues to scream, yell, swear, and struggle. Then he gets zapped and wonders why.

You are correct -- he was not arrested until he pushed the police -- and up to that point he could have walked away without being arrested. Kerry didn't run in 2008. He was still in the senate then, and now. Look, I'm not saying the officers are at fault-what's at fault is our attitude towards law enforcement. Instead of keepers of the peace, they're "keepers of the rules." If, by virtue of enforcing the peace, you create more discord than you prevent, you're doing it wrong. It's a philosophical problem with how things are organized-but by that reasoning, yes, the individual officers involved weren't at fault.
