This is the fourth edition of Papoose's educational Law Library songs.

Stop committing murder or manslaughter for a moment.

If it's a full moon listen to sun for a while.
Take a moment to calm down, even if you're feeling volatile like the moon.

The definition of homicide is the conduct
Homicide is when someone's actions result in the death of another person or unborn child.

that causes the death of another person or a unborn child.
It is the cause of death that defines homicide.

I send these words to a mother if her sons on trial.

This is something to think about seriously.

If you intend to cause physical injury to a person and you kill em.
If you intended to injure someone but they die, you may be charged with manslaughter instead of murder.

Thats not a murder thats a lesson charged sub-division.
This is a lesser charge than murder.

This is an important legal code everyone should know.

If you catch a body under emotional disturbance.
If you kill someone in the heat of an emotional moment.

That does not constitute murder. So you gotta chance.
This may not be legally considered murder, so it could result in a lesser charge.

Cause it constitutes a medicating circumstance.
It may be seen as excusable due to mitigating circumstances.

Temporary insanity if your lawyer is in order.
If your lawyer is skilled enough, temporary insanity can be used as a defense.

You could have a murder charge reduced to a man-slaughter.
You could potentially receive a less severe charge of manslaughter instead of murder.

Cop out to a dime 15 years shorter.
Pleading guilty can mean a reduced sentence.

Or you could end up with a quarter. To life.
You could receive a sentence of 25 years to life.

Life Liiiife.
Repetition of 'life' to emphasize the seriousness of the subject.

Further emphasis on the importance of life.

Continued repetition to emphasize the significance of life.

You just a pawn. I ain't talking about where you sell your jewelery.
You are a minor player in a larger game of life, not referring to pawns in chess or pawning jewelry.

Or a small lake where water be flowing fluidly.
Not referencing the scientific definition of fluidity.

Life is like a game of chess.
Life is a complex game where every move counts.

Honestly, people are dying every day.

Nothing new to me. Kids reaching for guns before they reach puberty.
Unfortunately, gun violence is not a new issue, and it's starting at younger ages.

Regardless of who committed a violent act, it's still black on black crime.

This kind of violence doesn't help the unity of the community.

Homicide police swarming through the community.
Police often increase their presence in communities after violent crimes.

They locking up you and me.
This means that both the perpetrator and innocent people in the community can be affected by this increased police presence.

Cause they only gotta prove 3 things to get a conviction
Proving motive, intent, and opportunity are crucial in a conviction.

Follow through with me. Thats the motive the intent and the opportunity.
Motive, intent, and opportunity are the three things discussed in this song that are needed to prove a crime.

Motive: That mean you had a reason to kill.
Motive is having a reason to commit a crime.

Intent: You intended to kill em did it at will.
Intent means that the perpetrator willingly intended to commit a crime.

Opportunity: This the most important and why? They place you at the scene
Opportunity involves being present at the scene of the crime.

if you don't give em a alibi.
Without an alibi, the perpetrator may be suspected of the crime.

A murder charge doesn't mean defeat.
Being charged with murder is not the end.

Some say through the technicalities its the easiest thing to beat.
Some believe that murder charges are easier to beat on technicalities.

Follow me through the court system I'm leading you out.
These lyrics will lead the listener through the court system.

They gotta prove you guilty beyond a reasonable doubt.
The prosecution needs to prove that the perpetrator is guilty beyond any doubt that is reasonable.

Its an affirmative defense out blatant.
A defense against a crime needs to be clear and upfront.

So if you start explaining. Give a reasonable explanation.
If a defendant explains their defense, it needs to be rational and sensible.

Reasonableness of which is to be determined from the viewpoint of a person
The defense's reasonableness will be judged from the perspective of someone in the defendant's situation.

The perspective will be that of someone who is defending themselves at the time of the crime.

Suspended license. Crash you'll make your life shorter.
Being charged with a vehicular crime can have serious consequences.

They could charge you with vehicular man-slaughter.
The charge for a serious vehicular crime can be manslaughter.

Criminal negligence they both go aside.
Negligence can also lead to criminal charges.

They call it criminally negligent homicide.
Criminal negligence can result in homicide charges.

I'm streetwise. Thats why I give you advice.

This advice is to ensure that listeners avoid spending their entire life in prison.
