@TheHeadincharge was it frivolous.... Hmmm not sure.... It arose because the compsny paying Ed royalties stopped doing so as it was that company that initially felt Ed had copied Sam's song. It was Ed that took action against that company for not paying royalties... That company would only pay the royalties if Ed could prove he didn't rip it off.

So... As I believe the original lawsuit was between Ed and that royalties company. Only later did Sam join in as that company may have first arisen the alarm bells.

So it wasn't really frivolous... It was on some calculated decisions by that royalties company as far as I understand... But please do correct me here if I'm wrong as I can't be bothered to investigate fully how it arose.

Nonetheless... It wasn't frivolous... It some legal justification... If it was really frivolous I'm sure the judge would also have penalised them for it in having them pay additional costs for the case.

Sadly I know some of this shit as I've previous as a very boring cunt of a barrister in intellectual property (not music though... Drugs patents). (So please feel free to correct me).
