This is crucial information. I didn't properly educate myself and went for an increase about 6 months prior to my 5 year window. I am pretty sure they will come up with something to reduce me, but I know now. It's the little things like this that make a world of difference. Keep it up because we need to understand the game in order to play it.

I learned the hard way early on. I retired in 2004 at 80%. Barely went to my appointments eventually I got reduced to 60%! I wasn’t educated! That was a bad experience. I am currently 100% P&T for 6yrs now. I will let other vets know about this YouTube channel so they want experience what I did.

Hi Dewayne, thanks for sharing this critical information. Initially filed a sleep apnea claim without being educated so we know what happened there. I have since had a sleep study and was issued a CPAP device by the VA. Because there was no evidence of an in-service event, should I close out the claim as a direct, or can I just modify that claim as secondary to migraines or tinnitus?

Great info! Thanks for all you do to help us 'get educated'. How does this work if the vet is 55+? Per my C File, my SC Anxiety Disorder is from 5/9/2022. But I am over 55 yo. Once the upcoming criteria changes to mental health disorders go into effect, I may file for an increase. I'm wondering if the over 55 rule protects me from the situation you describe.

GOMAB! Thanks for sharing information that is not common knowledge. You mentioned something that caught my ear, "you need two exams outside of the 5 year period to reduce you. I have two claims that are currently deferred and have had two c&p exams for each claim and still haven't received a rating yet (CFS and Depression). I have also had a second c&p exam for hearing loss, even though they denied my claim, but awarded me 10% for tinnitus (which I never made an initial claim for).

If this is true, the 5 year period for a condition. I was awarded 10% for GERD in 2014. then October 2023, I was working on my refile, went to C&P, and the nurse practitioner put in her notes, that I've been taking medication for GERD, VA reduced that 10% rating to zero. I got out of the military in August 2013 and received my first rating in May 2014. 9 years of receiving payment for the GERD, but now, with other issues, secondary conditions I am 80% and just finished a 2nd C&P last week, to hopefully get a 100% rating. But still, how can something be taken away if I had it for 5 years or longer?

Dewayne! Thank you for all the information and help you give! I have a question, currently 90% just got awarded in Feb of 24. I am 54 yrs old, my question is this… I am 70% PTSD..currently. I feel I need a little help with mental health due to PTSD, it affects me socially and occupationally. If I get help and the person I get help from states in notes and what now they feel there is improvement, If I turn 55 would I still have the chance of being reduced If I get help to better myself? I do not want my benefit taken away, but I do want to feel better. And I am NOT P&T, how can I get there? Thank you!

If you go into your ptsd counseling and talk about improvements they will reduce you. Everything you say is being recorded by them. At the end of the meeting between you 2 they will produce a sheet about EVERYTHING that was talked about and your current conditions.

@michaelerickson3626 to be honest with you, brother. You have to play their game. You CANNOT hint that you are getting better even though you want to be. They will reduce you. If your in school and they ask. So how's school? School is going good I have good grades I enjoy the assignments and the work. I get along fine with my classmates etc etc. That statement to them is that your condition is improving. They ask you. So how is your home life? My wife and I are doing good we are getting along better. I'm doing really well with my kids etc etc they will take it as you are improving. You have to use discernment when speaking to them. Don't tell them everything and anything. Be vague and frank. It's extremely unfortunate we all have to play these games with them but it is what it is.

What if you are past the 5 years and the code sheet shows the service connected issues as static, then the VA opens a new claim in March 2024 showing 930RC (Rating Control) because you filed for secondaries for migraines related to tinnitus, and frequent/urgency urinary issues related to lower back service connection, almost 8 years later because the effective date is August 2016, but they reopened cervical neck/fused, upper radiculopathy, and 0% scar on chest, and 10% painful scar on neck that were service connected as static in 2018? I understand the VA reopening tinnitus, but not the other issues that don't seem relevant to the secondary claims. My understanding of 930RC (Rating Control) is they believe they made a mistake when they rated the conditions in 2018, and now could possibly reevaluate to reduce? This doesn't seem like a positive thing for the veteran who is at 90% and trying to hurdle to 100%

The new claim would be for the secondary claimed condition. Your previous rating decisions and code sheets would have to be reviewed and the claim form you submitted to see what the VA is trying to do. I've seen VSR's and RVSR's request exams in error. What if I have a mental health condition that is rated at 50%, just rated 2 months ago. I also am a bruxer but I only just recently realized this is a compensable condition. I would like to put in a claim for bruxing (grinding teeth), tied to my mental health condition. Can they reduce my rating on mental health?

What you talked about here in this video is why I try to never go to any VA clinic. I'm to scare to go. Example I get disability for my knees. My knees have been getting worse and my left knee sometimes feels like it wants to snap in half. I need to see the doctor, but I do not trust any person working for the VA. So I have been suffering.

I get better care from UNC or DUKE doctors, hospitals than the VA.
The VA is "always" playing games to screw over veterans and that is why I don't trust them.

I was initially rated 70% for PTSD and was contacted 8 months later for another C&P exam for PTSD. I was then increased to 100%…. Reexaminations aren’t always a bad thing.

Normally that is the case but if you have a rater that has been trained right. If they look at the progress notes and it shows things have worsen, they can increase the rating. @SubwayAce there are more benefits once you're 100% p&t that are worth fighting for.... how about free health insurance for my family, no taxes on my house... college paid for my son in Florida and also gets $1488 a month to live on.... it's worth the risk to get that p&t.... if you have legit issues it shouldn't be an issue of poking the bear.... I am 100% p&t at 47yrs old and I have 3 more possible claims that would be service connected if I chose to file

I wouldn't. You're risking your $3,800 per month for just an extra $200 If you open a new claim they can re evaluate you for your current conditions. You're already at 100 PT. Just go get seen and treated for free for your ED at the VA. They will treat you for any and all conditions regardless if they are service connected or not.

Unrelated.. I was in the navy was stationed on a small ship with just corpman. Got PFB (razor bumps) it was noted I'm one of my annual reviews in my medical record but no diagnosis from a actual doctor while in service. My claim was denied without even a c&p exam. Probably for SMC. I know several 100% rated vets including myself that are eligible for SMC but aren’t receiving it. To be on the safe side I’m waiting out that 5 year period that Mr Kimble is talking about. However I’m also waiting out the 10 year clock rated 100% so I don’t jeopardize my family’s DIC benefits. He doesn’t cover that in this video but I’m sure he will at some point.
