@Hecka Much Magazine I definitely agree with you on this, but it’s going to take a short while for the necessary societal changes to occur before these positive changes can be implemented into society correctly. Radical paradigm shifts require intensive preparation and foresight to correctly implement these types of changes, or it can negatively impact society just as much as the previous system, and potentially worse if it’s not handled with insightful care and planning.

@Monke Mode Yeah, intent is the difference between murder and manslaughter. It's the difference between white hat and black hat. These court cases are fought mainly on evidence that shows intent. If someone hacks into a system then tells the admins they were hacked, it's pretty clear they weren't trying to steal anything. If someone sells malicious code it's pretty clear the intent was self gain. A store owner who sells a gun to someone like that can be charged as an accessory to murder.

Congratulations to Marcus on it all been finally over, the stress can get you down. I'm sure most of us have been in similar situations one way or another, I've personally had software getting flagged as a Trojan by many firewalls and virus detectors. I know for a fact I wasn't using it as such, but when I think back I guess it could have been used as one. As technology progresses and I'm sure it's pace will increase, humanity will need more like you, me and many others. we all live and learn

The simple fact is that WannaCry only happened because of the greed and need for power that specifically the NSA had. As a completely obfuscated organization, they had no obligation and also took no responsibility to ensure that "the citizens they protect" were safe and they will continue to do this with every possible avenue and technology they can. They knew about the weaknesses of Windows and created Eternal Blue knowing that not only Americans used it, but also people across the world (as evident by the fact that the UK was the most affected be wannacry, not the US). What do you think they intended to do with that knowledge, which they lied to Microsoft about and told them everything was safe? They thought that no one else would figure out the weaknesses or get their hands on Eternal Blue which is simply arrogance. If they wanted to actually keep people safe, they would have assisted companies (some of the contractors you talked about) like AT&T and Microsoft in fixing these problems instead of exploiting them, or forcing or tricking them into giving them control, as Edward Snowden discovered.

Keep it in perspective, the FBI still acted like a bunch of assholes. In fact, the guys dealing with wannacry were pissed at the dip shits who went after him for Kronos. The JUDGE had to step in and provide some sanity, NOT the FBI. It's not a feel good piece at all, it's that by some random chance he got on the docket of a judge with some sense of proportionality and justice. That should scare the shit out of us.

Seeing what happened to Marcus and others had a profound influence on the Whitehat community in bad ways. For one thing Whitehat numbers decreased sharply and groups disbanded in fear of being prosecuted for trying to help. The only way to learn how malware works is to write it and test it. Creating such code is criminal as far as the law is concerned whether you use it for bad intent or just trying to understand it, the law makes no distinction. Not only are you an enemy of organized crime organizations and malicious governments world wide but also of law enforcement agencies world wide. It is a no-win situation in reality. A simple mistake can lead to you being murdered or incarcerated for years. The few still out there and working, work alone and live very hard lives. They are not paid because the best ones do not trust any corporate entities or governmental agencies because not everyone in any security company or government agency is a Whitehat. The operating word here is espionage. Most Whitehats understand that most companies and agencies have moles in them and understand that code spew can be worth billions of dollars and all it takes is one sellout to gain access to that code and good people are harmed.

So what i gathered from here was that the organization behind the Wannacry worm weren't pleased that Marcus found the way to stop the spread at that point, so they dig up his past and leak info about the fact that Marcus contributed to making the Kronos malware, which then reaches the FBI, and the FBI decides to make him a scapegoat cuz they didnt find the proper culprit behind the Kronos and Wannacry malware! Kudos to the judge for taking into account the whole scenario. Glad he did his job perfectly!

4:20 wtf... That was literally the most stupid thing I've ever heard. That was a very basic anti detection technique to detect whether you were running in a VM or not. He wanted to evade analysis in virtual environments by trying to contact a non-existing URL. VM DNS server usually tell you that server exists (even though it does not) to emulate internet access.
And to top it all: A killswitch to not infect yourself?!?! Wtf? A domain name which you have to register with your personal data?! Wtf. These guys have absolutely 0 knowledge of their area. Why would anyone do that? They can just decrypt the files themselves wtf

Great piece. So glad to have good people in the justice system or this would have had a sad ending. Amazing how corrupt so many FBI agents are. Going after a good kid like that. We can build better systems!

@Anonymous City I work in IT so yes I understand all of that. I did not say it was in accurate or wrong I just said it was a classic line from that generation in the way they worded it. Which is an odd way to word what they are describing. I did not say it was correct, wrong, good or bad. So take your superior hat off and stop just chiming in on things to try and show some slither of knowledge you think you have that somebody else does not have. Also wanacry was technically a worm not a botnet

The real hero was the jugde, getting a good end to this story.
That judge understood LIFE as it is.
Altough we cannot incentivate anyone to do bad things no matter the age, this kind of tech problems need a lot of training and Marcus's mistake was to sell parcial code. He should never do it. But with he's experience, he was able to avoid a big problem to the ignorants that don't keep up with their computers.

Appart of this:
People in general think that as they are doing harm to someone through a computer, if they are not cought it's ok, but that is not the case:
If you harm anyone, no matter the instrument, Karma will hunt you down and you WILL have to pay, one way or the other.
So...use good judgement before any action, word or thought.

This young man GOT VERY LUCKY in having a judge who understood the whole picture... Unfortunately the USA is in the business of putting good people who make a single mistake in PRISON... (I Know Personally)... I am so glad this young mans life was not ended w/ a 20 yr sentence and he is able to serve w/ the white hat hackers that protects our cyber society . Many blessings , SMR

Got a few friends who work in the NHS and a couple of buddies who supply systems for them, the NHS internally never met the requirements they set for others, so I wasn't shocked when it happened. Marcus, should be held as a 'hero', what he did, was a lot of work on his own back that the government and its own teams couldn't even figure out.

Marcus, I was convicted in Federal court of Conspiracy to commit copyright infringement in one of the largest software piracy cases in history called Operation Bandwidth. The FBI, in its typical manner, came after me, even though when the Millennium Piracy act became law in 2000, I advised the cracking group I had founded years earlier, and had left, to disband and cease all activities. Because I didn't and wasn't willing to turn them in, I was indicted for conspiracy. Strangely, I was never arrested, and the indictment was actually just mailed to me. Several years later, I was convicted, given no prison time or fines and even the court costs were waived. The FBI and the government made an example of me as well, and today I am a federal felon who has lost the right to own a gun. Other than that, and the waste of my time, the conviction has had zero effect on my life. It was stressful, of course, but it certainly was not about justice or the law. It was just about publicity for the government and making an example to intimidate anyone else who might consider software piracy. The government spent a fortune of taxpayer money on the case and not one of the 21 people indicted in Operation Bandwidth spent a minute in prison. https://www.justice.gov/archive/criminal/cybercrime/press-releases/2002/bandwidth.htm (BTW, the government even spelled my name wrong.)

I'm sorry, how is wasting 2+ years of your life in legal turmoil supposed to be an encouragement for future cyber security experts to save the world?

If he had known the long-term consequences of registering that domain he might have never registered it and WannaCry would continue to cause havoc.

Doing a good deed "saved him" from something that probably would've never been brought up if he hadn't done that good deed in the first place.
Why is this being summarized like a happy-ending story?
This man had suffered for a long period of time just for doing the right thing, this is more of a story of why not to be a hero than it is a story about why not not to sell malware.

This whole story gives me a lot of hope for humanity. Marcus is a great representation of what it should mean to be human. He said fuck you to the asshole lawyer asking $1.5 mil for a defense, faced the judge with genuine honesty ready to take responsibility for his missteps in years past, and the judge went against the grain to let him off with time served. That's always been the way things should work in my opinion. A great testimony for less corporate/government standardization and more power to the local nodes of leadership and authority to make judgement calls based on the situation.

Even a intelligent person like him.
Yet without beeing punished or charged he changed away from doing crimes.
This totally prooves how useless it is to take away young peoples freedom and especially how useless it is to punish old people for what they did when they were young!
It also proofes that only billionaires get to see justice in the USA.

Posting individuals adresses anywhere to the public without their consent (not including small friendgroups and familys abviously) should always be made illegal. Imagine someone posting you adress name etc online and you suddenly get send a lot of shit you didnt order and are pressed to pay them.
