In April 2009, a new lineup was announced with Cazares returning and Gene Hoglan as drummer. Bell and Stroud are both reprising their respective roles, and the band completed a seventh studio album entitled Mechanize. Former members Christian Olde Wolbers and Raymond Herrera (both currently playing in Arkaea) dispute the legitimacy of the new lineup, and a legal battle is underway from both parties. The band has performed at three Ozzfests as well as the inaugural Gigantour and has had singles in the US Mainstream Rock Top 40 and albums in the Billboard Top 40, 100, and 200. The band has sold more than 1 million albums in the US alone.
Default Judgement

Your intention to scar me
Discrimination
Your a suspect penalty
I suffer!
Spiteful resolution
By your sentence we must fall
Bitter thoughts destroy us all
We suffer!
Suffer!
Your final judgment stands
Made by your will
I never had a chance
I never will!
By your default judgment
Everyone has suffered
Your pointless judgment
Caused everyone to...suffer!
Suffer!
Your final judgment stands
Made by your will
I never had a chance
I never will!
Day in which god
[Repeat: x6]
Judged humankind
Mankind
Mankind
Your final judgment stands
Made by your will
I never had a chance
I never will!
[Repeat: x8]
Never
The lyrics to Fear Factory's song "Default Judgement" are about the effects of discrimination and the anger and resentment that it can cause. The singer is addressing someone who has intentionally tried to hurt them, referring to them as a "suspect penalty." The discrimination they've experienced has left them suffering, feeling as though they are at the mercy of someone else's will. The repetition of "suffer" emphasizes the pain and anguish the singer is feeling.
The second verse shifts to a broader perspective, as the singer notes that the spiteful resolution of one individual can have a destructive effect on everyone. Bitter thoughts can destroy us all, the singer says, and everyone has suffered as a result of the judgement handed down by this one person. The repetition of "Suffer!" at the end of each verse underscores the message of the song - that the pain caused by discrimination is deep and lasting.
The reference to a final judgement made by God in the third verse adds a religious dimension to the song's message. It suggests that discrimination is a sin, and that those who perpetrate it will ultimately be held accountable. The repetition at the end of the song of "Never" emphasizes the sense of hopelessness and despair that the singer feels.
