Correct me if I'm wrong, but you seem to be insinuating that any song that sounds like another song is plagarism. But that's how art works- taking what has been done before and making it your own. Arguably the most famous statement concerning the nature of Art came from Picasso - "Art is theft". To deny artists and musicians carte blanche to borrow from and take inspiration from others is to deny art itself.


Yes, the chords and rhythm of "Spirit" and "Stairway to Heaven" are simliar, but that's no basis for a lawsuit, especially when one considers that the riff in question is played takes place in the first two minutes of a song that then proceeds to continue for another 6 minutes. Not only that, but the riff itself has features different instruments and a vocal performance and lyrics, all of which are completly absent from the "Spirit" (though that is a beautiful song, in it's won way).

2. One possible explanation:
A riptide is a current within a body of water. I have seen them in the San Juan Islands in Washington State. The ones I saw were 20 to 30 feet wide. It is like a river pulling things caught in it out to open water far from shore. It is caused by the tides flowing out of areas with pieces of land that cause a bottleneck. The current accelerates going thru these passages. These can be narrow bands of moving water within a large body of water. It is conceivable Randy pushed his son out of the quickly moving current to the calmer water where he could swim to shore.
